Will my HOA allow a casita in the Tucson area?

Updated October 2026

It depends on your CC&Rs. Arizona's ADU laws limit what cities and counties can require, but both say they do not prohibit restrictive covenants about ADUs between private parties. An HOA declaration is such a covenant, so if it restricts second units, rentals or accessory buildings, the HOA can enforce it even after the permit is issued.

Why doesn't state law override the HOA?

Both Arizona ADU statutes, the one for cities and the one for counties, are written to limit government. Each says it does not prohibit private restrictive covenants about ADUs, while stopping the city or county from requiring a covenant or tying a permit to one. Your HOA's rules sit on the private side of that line.

What should I read in my documents?

  • The declaration (CC&Rs): single-family use language, accessory building limits and leasing rules.
  • Design guidelines: height, setbacks from neighbors, roof material, stucco color and wall finishes.
  • Architectural review procedure: what to submit and how long the committee has to answer.
  • Amendments: rules may have changed since you bought the house.

Where are HOAs most common around Tucson?

Usually in newer master-planned neighborhoods, in the city and in the towns alike. Many older Tucson neighborhoods have no association, though some carry deed restrictions from the original subdivision. We check the recorded documents either way.

What if the wording is unclear?

Ask the architectural committee in writing before paying for full drawings. A written answer is worth more than a neighbor's memory of what was approved before. For a real dispute, talk to an Arizona attorney who handles community association law; we build casitas, we do not give legal advice.

How we handle it

We design to the stricter of the HOA and the city or county rules, prepare the committee submittal, and file with the permit office once the HOA path is clear.
